OVERVIEW
Welcome to Pawthecary. "We", "us" and "our" mean Pawthecary, a trading name of Rodica Murphy and [ELIZA FULL NAME], who trade in partnership in England. Pawthecary runs this website and online store, including all related content, features and products (the "Services"). Our store is powered by Shopify.

These Terms, together with our Privacy Policy [LINK], Refund Policy [LINK] and Shipping Policy [LINK], explain your rights and responsibilities when you use the Services. By using the Services, you agree to these Terms. Nothing in these Terms affects your statutory rights as a consumer.

SECTION 1: ACCESS AND ACCOUNT
You must be at least 18 to buy from us. When you order, you'll give us information such as your email, delivery address and payment details, and you confirm it is accurate and up to date. You're responsible for keeping your account login secure. You may not transfer your account to anyone else.

SECTION 2: OUR PRODUCTS
We do our best to show our products accurately, but colours can look different depending on your screen. Product descriptions may change. We may discontinue products or limit quantities at any time.

Our products are cosmetic care products for dogs. They are not veterinary medicines and are not intended to diagnose, treat or prevent any condition. If your dog has broken skin, a wound or an ongoing skin problem, please speak to your vet. For external use only. Stop use if irritation occurs.

SECTION 3: ORDERS
When you place an order, you are making an offer to buy. A contract is formed when we email you to confirm your order has been dispatched. We may decline an order, for example if a product is out of stock or there is a pricing error. If we do, we'll let you know and refund any payment in full.

Returns and cancellations are covered in our Refund Policy [LINK]. Our products are sold for personal use only, not for resale.

SECTION 4: PRICES AND PAYMENT
Prices are shown in pounds sterling. Postage is shown at checkout before you pay. The price you pay is the price shown when you place your order. We may change prices or run promotions at any time. Separate promotion terms will apply where stated, and if they conflict with these Terms, the promotion terms apply.

You confirm you are authorised to use the payment method you provide.

SECTION 5: SHIPPING AND DELIVERY
Delivery details are set out in our Shipping Policy [LINK]. Delivery times are estimates. Your order remains our responsibility until it is delivered to you or to someone you've nominated. Ownership passes to you once we have received full payment.

SECTION 6: INTELLECTUAL PROPERTY
Everything on our site, including the Pawthecary name, logo, text, images, designs and product names, belongs to Pawthecary or our licensors and is protected by UK and international intellectual property law. You may use the site for your own personal use. You must not copy, reproduce, republish or use any of our content or trade marks without our written permission. Shopify's name and logo are trade marks of Shopify. Other names and logos belong to their respective owners.

SECTION 7: OPTIONAL TOOLS
We may give you access to tools provided by third parties. We don't control or monitor these tools, and we provide them without any endorsement. Using them is at your own discretion, and you should read the third party's terms. New features we add to the Services are also covered by these Terms.

SECTION 8: THIRD PARTY LINKS
Our site may link to websites run by others. We aren't responsible for their content, products or practices. Please read their policies before you buy or share information with them.

SECTION 9: RELATIONSHIP WITH SHOPIFY
Pawthecary is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Pawthecary. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Pawthecary, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Pawthecary.

SECTION 10: PRIVACY
Personal information we collect is covered by our Privacy Policy [LINK]. Some information is also processed by Shopify under its own Privacy Policy (https://www.shopify.com/legal/privacy/app-users). Because our store is hosted by Shopify, your information may be shared with Shopify and other service providers, some of whom may be located outside the UK.

SECTION 11: REVIEWS AND FEEDBACK
If you send us reviews, photos, ideas or other feedback, you give us a free, worldwide, ongoing licence to use, edit and publish it to run and promote Pawthecary. You confirm the feedback is your own, is honest, and doesn't break anyone else's rights. You also confirm you've told us about any incentive you received for it. We may remove feedback that is unlawful, offensive or misleading.

SECTION 12: ERRORS
Occasionally our site may contain errors, such as in pricing or descriptions. We may correct them at any time. If an error affects your order, we'll contact you and you can cancel for a full refund.

SECTION 13: PROHIBITED USES
You may use the Services for lawful purposes only. You must not: use them unlawfully or to harass anyone; upload viruses or malicious code; copy, scrape or resell any part of the site; use robots, scrapers or automated tools (including agentic AI) to access the site; collect other people's personal information; or try to get around our security measures. We may suspend or close accounts that break these Terms.

SECTION 14: AGENTS
14.1 This section applies if you use, allow or deploy an Agent to access, use or interact with the Services. "Agent" means any software or service that takes autonomous or semi autonomous action on behalf of, or at the instruction of, any person or entity, without direct supervision.
14.2 No Agent may access, use or interact with the Services unless, at all times, it identifies itself and operates in strict accordance with section 14.4. No Agent may access the Services if we have asked it not to.
14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses or interacts with the Services.
14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request comes from an Agent and give the Agent's name by including "Agent/[agent name]" in the user agent string; (ii) not conceal that any access comes from an Agent, for example by mimicking human behaviour or completing or getting around CAPTCHAs; (iii) answer truthfully any question asking whether interactions come from a human or a computer; and (iv) not get around any measure intended to control Agent access.

SECTION 15: TERMINATION
We may suspend or end your access to the Services if you break these Terms. You remain responsible for any amounts owed up to that date. Sections that by their nature should continue (such as Intellectual Property, Feedback, Limitation of Liability and Governing Law) will survive.

SECTION 16: OUR RESPONSIBILITY FOR PRODUCTS
We are legally required to supply products that are of satisfactory quality, fit for purpose and as described. If they aren't, you have rights under the Consumer Rights Act 2015, including repair, replacement or refund. For more on your rights, visit Citizens Advice. SECTION 17: LIMITATION OF LIABILITY
If we break these Terms or are negligent, we are responsible for loss or damage you suffer that is a foreseeable result. We are not responsible for loss that isn't foreseeable, for business losses, or for losses caused by events outside our reasonable control.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit, including your statutory rights.

SECTION 18: INDEMNITY
If you break these Terms or the law when using the Services, and a third party brings a claim against us as a result, you agree to cover our reasonable losses and legal costs arising from that claim.

SECTION 19: SEVERABILITY
If a court decides any part of these Terms is unenforceable, the rest still applies.

SECTION 20: WAIVER AND ENTIRE AGREEMENT
If we don't enforce a right straight away, we can still enforce it later. These Terms and the policies they refer to are the whole agreement between you and us.

SECTION 21: TRANSFER
You may not transfer your rights under these Terms without our written consent. We may transfer ours to another business, and if we do, your rights won't be reduced.

SECTION 22: GOVERNING LAW
These Terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales. If you live in Scotland, you can also bring proceedings in Scotland.

SECTION 23: HEADINGS
Headings are for convenience only and don't affect the meaning of these Terms.

SECTION 24: CHANGES
We may update these Terms from time to time. The version on this page when you place your order is the one that applies to that order. We'll give notice of any material changes as the law requires.
